Terms and conditions - event organizers (Spain)

Interested parties

1. 3cket = the platform; 
2. EVENT = event, over a defined period of time, in a physical or digital environment; 
3. PROMOTOR = client of 3cket and final provider of services to the participant; 
4. PARTICIPANT = participant in the event and client of the promoter; 
5. USER = holder of the 3cket account, regardless of whether they are a PARTICIPANT or a representative of the PROMOTER; 

PARTICIPANTS in EVENTS and 3cket accounts

7. PARTICIPANTS are subject to an obligatory registration with name, e-mail, mobile phone, gender and date of birth. This registration is unique for each telephone contact and 3cket account and is global for all 3cket functions of the respective PARTICIPANT - regardless of the PROMOTER; 
8. The 3cket account allows the USER to manage personal data, marketing consents and access the functionalities provided by 3cket and the PROMOTERS, as well as consult the transaction history and access invoices relating to all the services provided by 3cket and the PROMOTERS through 3cket; 
9. PARTICIPANTS with a 3cket account authenticate themselves by validating their telephone contact by SMS or password in order to be able to use 3cket tools independently of the PROMOTER without the need for a new registration; 
10. All manual registrations - for example, sending invitations or private sales - or registrations imported into the 3cket platform - for example, external sales platforms or importing lists of participants - are not linked to a valid 3cket account; 
11. To activate the 3cket features available at the respective event, the PARTICIPANT must join a 3cket account; 
12. PARTICIPANTS with a registration disconnected from a 3cket account have reduced access to 3cket functions. 

Data policy

13. The personal data associated with 3cket accounts are the property of the respective USER; 
14. The management of 3cket account data is carried out exclusively by the USER. The PROMOTER is excluded from being able to modify personal data relating to 3cket accounts, regardless of whether this impediment directly affects their EVENT; 
15. The promoter may modify personal data relating to participants in its EVENT(S) only in cases where the PARTICIPANT's registration is disconnected from a valid 3cket account; 
16. 3cket es el responsable del tratamiento de acuerdo con la política de privacidad disponible en support.3cket.com a los efectos de: 
        A. sales processing of reservations; 
        B. process credit purchases, purchases of products and services and other transactions; 
        C. integration with subcontractors. 
   D. communication and clarification; 
        E. processing customer information and service requests; 
        F. processing of complaints; 
        G. statistical analysis activities; 
        H. verify, maintain and develop systems; 
        I. promotional communication and direct marketing. 
17. El PROMOTOR es la entidad responsable del tratamiento de los datos de acuerdo con la política de privacidad disponible en support.3cket.com y garantiza el cumplimiento de las responsabilidades inherentes a dicho tratamiento; 
18. The PROMOTER, as well as 3cket, will only be able to use the data for marketing purposes if there is consent from the USER given through the 3cket platform; 
19. 3cket is the entity responsible for processing the PARTICIPANT's consent within the platform; 
20. The processing of consent on external platforms is the responsibility of the PROMOTER. 

Book sales

21. "RESERVATIONS" are considered to be sales of tickets, experiences, accesses and the like, free of charge or not; 
22. Private reservation sales -initiated through the backoffice- and public sales -through public sales pages- give rise to a time link for finalizing the order. This link is personal and non-transferable, so any unauthorized sharing of it may result in the loss of the booking option or duplicate payment of the same order; 
23. It is the PARTICIPANT'S responsibility to duly confirm the information entered on the purchase page when finalizing the order; 
24. Reservations sold through 3cket give rise to a digital ticket - called 3cket Wallet - assigned exclusively to one holder. The 3cket Wallet is personal and non-transferable and must be correctly assigned to the PARTICIPANT who will be using it; 
25. The PARTICIPANT has the right to change the ownership of the 3cket Monopoly to its correct owner at any time. The PROMOTER, as well as 3cket, reserve the right to deactivate the change of holder whenever necessary to guarantee the smooth running of the operation; 
26. Sales of reservations through 3cket have an operating cost applied to the total order which includes the costs of payment, invoicing and sending of tickets, as well as the costs associated with processing the refund of the reservation when necessary; 
27. The reference value of the cost of the operation is 6%, plus VAT, with a minimum of 1 euro, VAT included at the current legal rate; 
28. The cost of the operation is charged and invoiced to the PARTICIPANT directly by 3cket and may vary depending on the sales channel, geographical location and other market components; 
29. The cost of the operation may be borne by the PROMOTER by means of a simple request by e-mail; 
30. If the amount paid by the PARTICIPANT is incorrect or if they manage to purchase a ticket before its sale date or manage to purchase a reservation that should not have been available to them, 3cket reserves the right to cancel the ticket and refund the amount paid. This will apply whether the error is due to human error or technical error. 

Payments, top-ups and purchases

31. By "CREDITS" or "CREDITS WITHOUT CHARGE" is meant the 3cket Wallet balance resulting from payments ("CHARGES") in a 1:1 ratio, in which one (1) credit represents one (1) monetary unit, including taxes and fees; 
32. 3cket offers multiple payment methods for any of the available payment transactions -reservations, purchase of credits, purchase of products and others- whose processing is guaranteed by authorized payment entities that supervise the entire financial process and can reject payments that they consider fraudulent; 
33. A payment is considered to have been made when it is communicated to 3cket by the payment entity in charge of processing it, which may reject it or keep it pending verification for an indefinite period of time. 3cket does not validate payment transactions, even if no justification has been provided, until the payment entity has communicated it; 
34. In the event of abusive or fraudulent use of any means of payment, 3cket reserves the right to proceed with the annulment of the transactions associated with said payment transactions; 
35. The means of payment available and the entities responsible for processing them may vary depending on the amount and type of payment, the geographical location of the event or the participant, and may change at any time. 

Return of reservations, credits and payments

36. The PROMOTER may manually authorize the return of reservations. It is the PROMOTER's responsibility to ensure that there are sufficient funds to complete the operation and it is the PARTICIPANT's responsibility to complete the return process in their 3cket Wallet. If the process is not completed within the stipulated and announced period, the reservation will be automatically reactivated; 
37. In the event of cancellation or postponement of the date announced for the use of the reservation, the PROMOTER is responsible for the full refund of the reservation; 
38. 3cket provides the technological solution to process the returns whenever the PROMOTER secures the necessary funds to proceed with the return of the amounts; 
39. Returns will be processed within a period equal to or less than 30 days from the end of the period for making the return request, provided that the previous point is complied with at least 15 days before the end of said period; 
40. 3cket does not reimburse transaction costs under any circumstances; 
41. It is the PROMOTOR's decision to allow the return of the remaining credits without effect; 
42. If there is a possibility of return, the defined deadlines are communicated in the 3cket Wallet. It is the promoter's responsibility to communicate the same deadlines on physical supports at the event; 
43. Modification of deadlines or policy is only possible by request to 3cket. Once the final return deadline has been set, it will not be possible to reduce it in order to safeguard the interests of the PARTICIPANT; 
44. In the event that the PROMOTER allows the return of surplus credits, the PARTICIPANT must access the Monedero 3cket and follow the steps indicated in the return area. They must do so within the time limit set by the PROMOTER and indicated on the same; 
45. Once the deadline indicated for the return request has passed, no further return requests will be accepted without any exceptions; 
46. The transfer of the amount to be returned to the PARTICIPANT takes place up to 7 working days after the end of the period stipulated for the return. 

Operation

47. It is the PROMOTER's responsibility to make 3cket technology available to all entities or individuals operating the 3cket platform at an event. In the event that they fail to use it or operate the technology inefficiently, 3cket declines all responsibility;

49. It is the PROMOTER's responsibility to ensure that payments by their own means are correctly recorded by the operator in 3cket. Failure to ensure this will give rise to discrepancies which will be the sole responsibility of the promoter; 
50. Incorrect configuration of the 3cket technology can cause irreparable damage to the operation, and it is the sole responsibility of the developer to validate all configurations; 
51. Any need for corrections in the operation - for example, products charged erroneously to the customer or check-in made to a participant who in fact did not enter a location - must be corrected immediately by the operator in charge using 3cket technology. 3cket is not responsible for correcting situations which occur during the operation and which have not been resolved immediately. 

Attendance and training prior to the event

52. 3cket provides user manuals that must be distributed by the PROMOTER to all personnel who will operate the 3cket technology; 
53. The manuals are specific to each function to be performed -for example, bar, billing, sales, customer service- and are compulsory reading for the staff; 
54. Optionally, the 3cket team will instruct, either in person or remotely and prior to the event, on the operation of 3cket technology. All personnel who are going to perform a function involving the use of 3cket technology must be present at the training, at the risk of not operating 3cket technology correctly; 
55. All staff who are going to perform a function involving the use of 3cket technology must be familiar with the technological equipment: computers, tablets and smart phones; 
56. The 3cket support team at the event is responsible for instructing staff and the event organizers on the operation of the 3cket application, as well as assisting in the resolution of technical problems resulting explicitly from the use of 3cket technology at the event. Information about the event and its operation is not the responsibility of the 3cket team; 

Invoicing and financial products

57. When billing for payments, recharges and purchases through 3cket is contracted with 3cket, this will be carried out on behalf of the PROMOTER or the entity defined by the promoter for this purpose; 
58. 3cket has the PROMOTOR's mandate to issue invoices and related documents in the name of the entity previously defined and through the certified invoicing program; 
59. When a reservation or purchase of products is made, an invoice will be automatically issued through a certified invoicing program, including VAT of the type indicated by the PROMOTER. If no tax type is indicated, the maximum type in force will be invoiced; 
60. If an entity is subject to VAT exemption, an official document from the entity must be sent with reference to the exemption article; 
61. If the PARTICIPANT wishes their NIF to be included on the invoices, they must indicate this in the purchase process or place it directly on the Monedero 3cket before payment is made, otherwise the corresponding invoices will be invoiced to the end consumer; 
62. After a consumption operation, an invoice is issued detailing the products consumed at the legal VAT rate indicated for each product by the PROMOTER; 
63. The remaining unrefunded balance will be invoiced at the end of the EVENT at the maximum VAT rate in force; 
64. 3cket provides the SAF-T file relating to the invoicing produced in a given month from the 5th day of the following month. It is the PROMOTOR's responsibility to download the SAF-T file via the backoffice and communicate it to the Tax Administration within the stipulated deadlines; 
65. The delivery of the financial product resulting from sales through digital means of payment is carried out exclusively by bank transfer to the PROMOTER's IBAN - defined at the time of creation of the PROMOTER's account by sending a bank statement; 
66. The financial product resulting from sales made in person and invoiced through 3cket is the responsibility of the PROMOTER; 
67. 3cket reserves the right not to deliver the financial product until the EVENT has taken place, in order to safeguard the interests of the PARTICIPANTS; 
68. The PROMOTER may, prior to acceptance of a liability agreement, invoice payments made at the physical points through means external to 3cket; 
69. In the event that the payments in question refer to the purchase of credits, 3cket will not be able to invoice the products consumed with the VAT detailed, since it has no control over the invoices for payment in advance issued; 
70. Whenever the financial product of the EVENT is delivered by 3cket to the PROMOTER, 3cket reserves the right to charge any service cost against invoice. 

Network of partners and distribution channels

71. All 3cket EVENTS with public marketing -reservations or not- can be automatically advertised, distributed and sold on the 3cket membership network and channels; 
72. The 3cket membership network is activated by default for all publicly marketed EVENTS. If the PROMOTER does not wish to activate the sale on the 3cket Membership Network, he/she must indicate this at the opening of the event; 
73. If the PROMOTER wishes to activate marketing with entities external to 3cket, the conditions of the service must be negotiated directly with said entities prior to 3cket's mediation. 

Service level

74. The infrastructure in the 3cket cloud provides it for international partners. Our servers and databases are located in Ireland, with redundancy in different locations in Europe; 
75. Payments with MB WAY, Multibanco Reference and Tarjeta de Crédito are provided by SIBS - FOWARD PAYMENT SOLUTIONS, S.A. using DIGITAL PAYMENTS GATEWAY (DPG) technology. 3cket excludes the responsibility of providing digital payment services whenever SIBS or DPG are not available. 

Responsibilities of the PROMOTOR in the delivery of information

76. The opening and setting up of the event is the responsibility of the PROMOTER; 
77. In cases where 3cket, in agreement with the PROMOTER, configures the event, the PROMOTER must send all the information requested in due time and form. It is the PROMOTER's responsibility to validate the correct configuration of the event before it is made available to the public or marketing begins; 
78. It is the PROMOTER's responsibility to correctly define the accesses in the 3cket for each of those responsible for the event (administrator, team leader, bar manager, financial manager, ambassadors, staff, etc.); 
79. 3cket is not responsible for damage caused by incorrect configuration of the event. 

Revocation of the right to create EVENTS

80. 3cket reserves the right to suppress acts that violate gender and racial equality and sexual, religious and political freedom. 

Equipment

81. When requested by the promoter, 3cket will facilitate the rental of equipment so that the PROMOTER can implement the use of 3cket technology at the EVENT. 
82. The equipment provided by 3cket is the sole responsibility of the PROMOTER until it is returned to 3cket; 
83. 3cket reserves the right to charge the PROMOTER for any damage or loss of the equipment provided.
